Greenacres City Council voted to adopt Ordinance 2025-04 at second reading, revising Chapter 16 (zoning regulations) to refine the definition of live entertainment, remove the term “nightclub” from the code and eliminate a surety-bond requirement for certain businesses.
The ordinance updates Article 1 (definitions), Article 3 (district regulations) and Article 4 (supplemental district regulations) to clarify permitted uses and the standards for live-entertainment permits and mobile food-dispensing vehicles. Development and Neighborhood Services staff recommended approval and said the draft conforms with code criteria and state statute findings.
The council held a public hearing and closed the record before a motion to adopt was made. Council member Dougo moved to approve the ordinance and Council member Bousquet seconded. The motion carried on voice vote; the clerk announced the motion carried.
Deputy Mayor Diaz thanked staff, business owners and the fire marshal for meeting with the council and business stakeholders during the revision process. “This level of engagement allowed us to arrive at a solution that both ensures important safety matters are properly addressed and that business operations for our local restaurants are not unnecessarily hindered,” Diaz said.
Staff described the changes since first reading as primarily refining the live-entertainment definition, removing “nightclub” as redundant because it is covered elsewhere in the code, and removing the surety-bond requirement. The Planning & Zoning Board had recommended approval following an April first reading and a May community workshop.
Councilmembers who spoke in favor framed the revision as the result of dialogue with local businesses and city staff. No speakers remained when the public-hearing portion was closed. The ordinance text directs the city clerk to codify the changes and provides for repeal of conflicting ordinances and severability.
The ordinance will be included in the city code as directed by the adopting motion. Additional implementation steps — including updated permit forms and administrative procedures — were not itemized on the record at this meeting.
