The IndiGo Board of Directors adopted Resolution 2025-06 on July 17, approving an updated advertising and sponsorship policy that staff said modernizes standards and aligns the agency with recent court rulings on government advertising spaces.
Chief Legal Officer Robert Fry told the board the update replaces older, vaguer language and creates objective, viewpoint-neutral criteria for advertising on buses, bus stops, BRT stations and other assets. Fry said the policy aims to preserve advertising spaces for their intended commercial and operational purposes while reducing First Amendment liability.
Fry summarized the policy’s legal rationale: “...our policy falls in line with these this long line of court decisions, which basically hold that we can, we can maintain content based advertising guide guidelines, which are designed to preserve our advertising spaces for its intended purposes. But we cannot discriminate on the basis of viewpoint.” The board discussed the policy in brief and then adopted the resolution by roll-call vote.
Board members raised no objections at the meeting; the chair called for the motion and a roll-call was completed with the chair announcing the motion carries. The policy replaces the prior advertising rules and establishes a uniform, objective process for evaluating advertising and sponsorship opportunities across the agency’s assets.
