Commission recommends approval of 1-step county plat for 80 Seventh Street Estates

The Derby Planning Commission on July 17 recommended approval, 9-0, of a one-step county plat to split an existing platted lot on 80 Seventh Street into two lots, creating a new flag lot served by a 60-foot-wide access easement.

Assistant City Planner Everett Haynes told commissioners the property is close to city limits and that the proposed pole of the flag lot (the access drive) is 60 feet wide, matching the city's minimum local street pole width. Haynes said staff and the applicant's agent were still coordinating the legal form of the access easement and how maintenance covenants will be recorded.

Haynes also noted the city's staff had found petitions for public improvements on file associated with the original plat that included sidewalk, sanitary sewer and water improvements; because 80 Seventh Street already has some improvements, staff and the applicant will coordinate whether new or revised petitions are required. "We're gonna work on that prior to city council consideration," Haynes said.

Commissioners discussed a comprehensive-plan depiction that showed a potential future public street along the same alignment as the proposed access drive; staff said that if a public street were needed in the future, the current pole width would be sufficient and setbacks were being provided accordingly.

Commissioner Wells moved to approve the one-step plat subject to staff comments and authorize the applicant to proceed with final plat tracing; the motion passed 9-0. Staff will continue to work with the applicant on the access-easement instrument and any petition updates before city council consideration.
