Hawks Nest subdivision awaits Army Corps permit and HOA documents; no extension required now

The Wells Planning Board discussed the Hawks Nest subdivision at its July 7 meeting and was told Army Corps of Engineers approval and finalized homeowners association documents remain outstanding.
Wyatt Page of Adder Engineering, standing in for Lou Chamberlain, reported that a draft homeowners association document has been circulated but additional HOA language is still forthcoming. Page said the Army Corps permit had not yet been issued and that the Corps had advised waiting until October on construction timing because of concerns about bats. “The Army Corps of Engineering permit is still not in hand, and we do not know exactly when it may be,” Page said.
Planning staff said the town’s ordinance requires necessary permits to be in hand prior to approval but noted that the board has in the past allowed limited conditional waivers for automatic DEP permits. Staff said the existing extension on the Hawks Nest application runs through Aug. 18, and that no additional extension was required at the July 7 meeting. The applicant said the intent was to return to the board’s next scheduled meeting with the outstanding HOA and plan notes addressed.
The board did not take further action beyond confirming the timeline and expecting the applicant to return once the outstanding items are provided.
