Planning commission continues decision on beer-and-wine bar at 120 West Main after recusals

The Grass Valley Planning Commission opened but did not decide a conditional use permit application for a beer-and-wine bar proposed for 120 West Main Street on July 15 because the commission lacked a quorum able to act.

Commissioners agreed to hear public comment on the file (25PLN-22) but deferred a decision after Commissioner Gross recused himself because he owns property within the disallowed distance of the proposed business. Two other commissioners were absent, leaving the commission unable to take action; staff said the item will be renoticed for a future meeting.

The application was noticed for public hearing but no formal action could be taken. The commission asked Commissioner Gross to recuse himself prior to public comment; Gross stated he owned 309–311 Veil Street, which he said is within the disallowed distance of the 120 West Main location.

Members of the public provided comments while the commission recorded the hearing. One commenter, Matthew Colter, urged the commission to limit expansion of alcohol-serving establishments downtown and cited public-safety concerns. "There's already been a shooting there," Colter said while urging caution about expanding open-container areas downtown. He also told commissioners to review police logs, which he described as showing frequent incidents related to alcohol.

Staff and commissioners noted the commission does not set citywide policy on open-container areas; that responsibility rests with the City Council. Planning staff said the item will be renoticed with a date and time certain when it can be heard by a full commission able to take action.

No motion or vote on the conditional use permit occurred on July 15; the file will return to a future hearing with new noticing.
