A resident, Doug Daniel, spoke during public comment to renew requests for a meeting about ongoing issues with a neighboring property at 352 Lacey Road owned by the Malins. Daniel said his earlier letter had received no response and summarized concerns including repeated notices of violations from planning and zoning since 2023, alleged violations of binding elements tied to a 2023 zone‑map amendment, and a prior criminal citation involving a red kangaroo kept without required permits.
Daniel also said a county manager built a structure on the Malins’ property without a building permit and alleged inconsistent responses from the county: Daniel noted that a prior public quote attributed to Judge Bates expressed support for the Malins even though the property was engaged in litigation with the county. He asked again for a meeting with the judge or a written response to his letter.
County legal counsel Cassidy responded on the record that the county had sent multiple responses to Daniel and that pending litigation limits public statements by the county. Cassidy said records are available in the public record and in court filings and that meetings had not been denied but that the county would not comment publicly on matters that were the subject of pending district or circuit court proceedings. Cassidy offered to resend correspondence to Daniel and other authors of the letter and pointed residents to the public record for details.
Why it matters: public commenters raised allegations that an elected or managerial official built a structure without a permit and that enforcement has been inconsistent; county counsel said pending litigation constrains public comment but offered to make records available and to resend responses.
Next steps: Cassidy said her office would renew or resend responses and that interested residents may review public filings related to pending matters. Daniel said he would provide copies of his earlier letter to be included in the meeting record.
