Colleyville pauses Encore rate increase, joins cities to contest company’s proposal

The Colleyville City Council voted 7-0 on July 15 to suspend the July 31, 2025, effective date of a rate filing by Encore Electric Delivery Company and to authorize the city’s participation in a multicity steering committee to hire legal and consulting services to review and contest the company’s request.
Assistant City Manager Adrian Law said the suspension buys time for the city’s legal team and consultants to “review and analyze and negotiate” Encore’s filing. “If we took no action ... the request to increase rates would be deemed administratively approved. So by having the resolution approved tonight that allows a pause button on the rate increases,” Law said.
Law told the council the company’s filing would raise the average residential bill by about $7.90 per month — a 12.3% increase — and raised particular concern about proposed changes to streetlight charges. He said the filing is Encore’s first comprehensive base rate case in several years and that the city’s team will focus on both the base-rate request and the company’s proposed new treatment for street-light rates.
The resolution, R-25-560, directs the city’s steering-committee representatives to negotiate with Encore, hire and direct legal counsel and consultants, and take administrative or court action as needed. The resolution also records that under Texas law (PURA Sections 33.001 and 36.001) the city may suspend an effective date and recover rate-case expenses from the utility. The resolution passed unanimously.
Council members spoke briefly after the presentation; one member called the proposed increases “disheartening” and urged the city to press the company for reductions. No public commenters addressed the item during the hearing.
The council will receive updates from the steering committee and the city’s outside legal team as the review proceeds. Law said staff expects more detailed information before the end of the maximum statutory suspension period and will return to council with recommendations.
