The Planning & Zoning Commission on July 14 tabled a conditional use request to establish a weekend farmers market on County Line Road until its Aug. 11 meeting, after the petitioner failed to appear and neighbors raised liability and traffic concerns.
Staff converted the petitioner’s original special‑exception application to a one‑year conditional use to allow trial operation and data collection on traffic impacts at the intersection of County Line Road and Peachtree Drive. Planning staff said the county engineer requested a temporary use in order to gauge traffic before approving a permanent special‑exception permit.
At the hearing a mortgage holder for an adjoining lot, Purna Parekh, told the commission she had been advised by counsel that a farmers market could create liability exposure for the mortgage holder as a lienholder on the property. Planning staff explained that the mortgage holder is a financer and not the record owner, but acknowledged the concern; staff also noted the petitioner was not present to address questions.
Commissioner Nick Holmes moved to table the item until Aug. 11; Commissioner Jonathan McDonald seconded. The motion passed 5‑0. Staff told the petitioner the commission expects the petitioner to appear at the rescheduled hearing and warned that failure to attend could result in denial.
