The applicant had painted brickwork and used a single darker body/trim color; the Planning Commission had previously approved the project but imposed a condition that the existing brick adjacent to a parking structure remain unpainted.

After public testimony for both sides, the council found evidence in the Planning Commission record that suggested a prejudgment and abuse of discretion in how the commission handled the condition. Council voted 4–1 that an abuse of discretion had occurred; then by a 3–2 vote the council directed staff to return with a resolution upholding the project and removing the earlier condition that required the brick remain unpainted.
