Board approves personnel actions after debate over waived relocation charge

Board member Van Hook asked that the personnel item be pulled from consent for discussion because a listed employee’s liquidated damages had been waived. Van Hook said waiving liquidated damages “weakens the enforceability of future agreements” and that the board lacked visibility when waivers are granted.
Staff member Johnson confirmed the relocation was a last-minute move and that the move constituted an out-of-state relocation. Johnson said the district has historically waived liquidated damages for relocations.
President Amanda Wade moved to approve the personnel action items and Board member Glover seconded. The motion carried unanimously. The board did not record any separate vote on the waiver itself; the personnel packet, which included the relocation and the waiver as part of the item, was approved 5-0.
Board members who spoke requested clearer visibility into future liquidated-damages waivers and suggested the board consider whether separate notification or separate votes should accompany such waivers going forward.
