The Town Board spent a prolonged portion of its July 7 meeting debating Local Law No. 6 of 2023, which would amend the zoning code governing allowable uses in the M‑1 (industrial) district. Board members expressed differing views about whether to act immediately or wait for additional input from the planning board and Erie County planning.
“we've basically been dealing with this. We went through a moratorium. We went through… as a town board, have completely beat this something up,” Councilman Dan Kilmer said, arguing the board should move the matter forward because members have had ample time to form positions. He added the five board members should “know what we want when it comes to this law.”
Other board members urged caution. One member said a preference to wait for the planning board’s input, noting the planning board had canceled a recent meeting that would have considered recommendations. That board member said the public hearing had been left open to receive additional comment.
After discussion about procedure — including whether to adopt a negative declaration under SEQRA and then the local law — a motion to leave the local law on the table passed on a roll call vote with four members in favor and one opposed (Councilman Kilmer). The motion keeps the item on the table pending further planning board feedback and additional review at upcoming workshops and meetings.
No change to the M‑1 code was adopted at this meeting; the public hearing remained open.
