CPC renews convenience-store SUP for Ledbetter gas station without expiration after discussion on enforcement

The Dallas City Plan Commission voted Thursday to renew a specific-use permit (SUP) allowing off-premise alcohol sales at a convenience-store property on East Ledbetter Drive, removing a prior expiration date on the permit.

Staff presented the case (Z245180) for the property, identified in the record as a general-merchandise or food store under 3,500 square feet, and noted the operator maintains a Chapter 12B registration that is renewed annually. Staff recommended that the SUP be continued without a fixed expiration, saying land-use practice among peer cities generally treats ongoing retail uses like this as long-term permissions rather than temporary authorizations.

Several commissioners pressed staff on the policy change. Some said SUP renewals are an enforcement tool neighborhoods rely on to address chronic problems linked to particular operators and wanted renewals or shorter terms to remain an available lever. Staff and other commissioners said revocations and other enforcement mechanisms (business licensing, Alcoholic Beverage Commission action and code enforcement) are the normal tools to address bad actors and that routinely imposing expiration dates is not common practice in peer cities.

After discussion, the commission voted to approve staff’s recommendation. The motion passed, with commissioners noting they would relay neighborhood concerns about maintenance and compliance to the operator and the city’s enforcement divisions.

Action: The commission closed the public hearing and approved the SUP renewal, subject to the site plan and conditions recommended by staff; the SUP was authorized for a permanent (no-expiration) period rather than the shorter renewals previously used.
