Sarah Schechter, the division'assigned attorney from the Attorney General''s office, told the board the division filed its answer to the Great Salt Lake complaint and the plaintiffs' initial disclosures have been received. The division's disclosures are due in a few weeks.
Schechter said the AG'office has retained outside counsel to assist with document production because private firms have greater capacity to handle large document reviews. She said once document production and initial disclosures occur, the case will proceed into discovery, which may include depositions and expert discovery on technical issues such as wildlife, brine shrimp and salinity impacts.
Schechter said the division may ask the board to meet offline to discuss legal strategy if discovery raises issues requiring board input.
Ending: No timetable for deposition or trial was provided; document production deadlines are the next immediate step.
