The Lake County Board of Commissioners met in a special session June 25 and moved into an executive session to discuss proposed renovations to the Lake County Courthouse and negotiation strategy, but made no formal decisions.
County Manager Kenneth Bryant read the statutory basis for the closed meeting, saying the session would be held “to hold a conference with staff on proposed renovations to the Lake County Courthouse and determine positions relative to matters that may be subject to negotiations, develop a strategy for negotiations, and or instruct negotiators pursuant to Colorado Revised Statutes 24-6-402(4)(e).” Commissioners Bullock and Lee made and seconded the motion to enter the executive session; the roll call vote was recorded as three ayes and the board recessed into the closed meeting. Present for the session were all three commissioners, County Manager Kenneth Bryant, County Attorney Chris Floyd, owner’s representative Colin Kaneda, Peter Sider (technical consultant, MWL), and Todd Raper (representing the owner/DPM).
After the executive session the board reconvened and recorded that it had been “unanimous to come out of executive session.” Meeting participants stated explicitly that “no decisions were made in executive session.” The special meeting was then called to adjourn; the clock time when the board emerged from the closed meeting was recorded as 1:42 p.m.
Because the discussion occurred under the exception in Colorado’s open meetings law for negotiation strategy and instruction of negotiators (CRS 24-6-402(4)(e)), the board did not disclose details of the renovation proposals or the negotiation positions discussed during the closed session.
