Board defers decision on Porter Farms bond release after developer and staff dispute punch list

The Board of Mayor and Aldermen voted to defer for two weeks a decision on releasing letters of credit for the Villages at Porter Farms phases 22, 23 and 24 after a developer and town staff differed over whether required punch-list repairs have been completed.
Town engineer Dale Perryman told the board the one-year warranty period for the work expired after final surface asphalt was installed on Nov. 14, 2022, and that a punch list prepared on Nov. 6, 2023, identified remaining repairs to streets, sidewalks, curb and gutter and inlets. Perryman said some items on the punch list have been addressed but others remain, noting evidence of failed inlet repairs and other areas marked by inspectors.
Developer Joel Porter said his contractor completed the items on the original punch list he received and that one inspector who produced later, additional items has died and another no longer works for the town. Porter said he met with staff and believed they had agreed on a list to complete; he asked for fairness and requested the deferral so he could complete remaining work and avoid a moving set of requirements.
Perryman and Porter indicated they would work to produce a specific plan and timeline; Perryman said staff could at least provide a plan for remaining work within the deferral period. Board members and staff noted the town must be confident that repairs are permanent before releasing maintenance security because, after final acceptance, the town (and thus taxpayers) assumes responsibility for maintenance.
The board made a motion to defer for two weeks; the roll call recorded yes votes by Mr. Jordan, Ms. Marshall, Mr. Stamps, Mr. Robbins, Mr. Hall and Mayor Frazier. No nay or abstention was recorded in the transcript.
