Council approves amended preliminary plan for Canyon Crossings with cross‑access conditions

The Ivins City Council on June 19 approved the Planning Commission’s recommendation to accept an amended preliminary plan for Canyon Crossings, a subdivision located near Snow Canyon Parkway and Snow Canyon Drive.

The proposal had returned to the council because the application predated a code change that shifted preliminary‑plan review to the Planning Commission. Staff and applicants explained that the split into two parcels requires a recorded declaration of restrictive covenants (cross‑access and cross‑parking) so both parcels retain the parking and access rights needed to satisfy city ordinance requirements.

Planning staff said the city will not sign the restrictive covenants but will have enforcement rights if the parties do not maintain required parking, access or conditional‑use permit obligations. Developers and council members also discussed trash access and the location of underground fuel tanks; staff said an existing construction and maintenance easement and state funds for fuel‑tank environmental remediation reduce the city’s exposure.

The developer said the amended plan was intended to keep the property functioning as a single mixed‑use node even after the legal split and to make rents more affordable on the retail side. After council questions and a motion to approve the Planning Commission recommendation, the council voted unanimously to accept the amended preliminary plan.

Council directed staff to carry the recorded declaration of restrictive covenants forward as a condition to the final plat stage.
