Ivins City OKs amended donation agreement allowing Ivins Inspired to raise funds for public art

Councilmembers and staff focused on donor protections and city oversight before approving the agreement. City attorney and staff speaker Brian (city staff) described the legal risks of accepting third‑party donations and asked for safeguards so donors would understand they were giving to Ivins Inspired rather than the city.
Michelle (Arts Commission member) told the council Ivins Inspired had prepared systems to ease fundraising, including online donation receipts, acknowledgement letters and insurance coverage. “Ivins Inspired welcomes the agreement set before you today,” she said, explaining the nonprofit can accept credit‑card gifts, IRA transfers and donations of appreciated stock — tools the city cannot provide directly.
Councilmembers pressed to remove language that would let the city unilaterally redirect donated funds. After discussion, the council agreed to strike the sentence that allowed the city broad discretion over the use of donated sums, to require clear donor disclosures, and to add a mutual‑termination clause so either party could end the relationship.
The Arts Commission will decide whether to use Ivins Inspired, the city, or a hybrid model for the upcoming Whitaker sculpture fundraising campaign; Michelle said the commission will vote next week and launch materials July 1 if approved. Councilmembers indicated support for allowing the Arts Commission operational flexibility, while reserving final approval of how donated funds are spent.
The motion to approve the amended agreement passed unanimously.
A follow‑up provision agreed by the city requires the Arts Commission to report annually on the fundraising arrangement so the council can revisit whether to continue the arrangement at that time.
