Board clarifies North of Cave Rock rental rule: residents may rent to other residents in permitted communities

AJ Hames, Douglas County planning staff, explained the board-level compromise: commissioners sought to prohibit typical tourist short-term rentals north of Cave Rock but allowed an exception so owners in certain north-of-Cape-Rock communities could rent to other residents with ownership ties to those communities. Hames said the exception was intended to limit the influx of tourists to remote neighborhoods while allowing limited intra-community rentals where an HOA or community controls access and behavior.
"The original idea was to prohibit all VHRs North Of Cape Rock... The compromise was, well, since certain areas North Of Cave Rock are essentially... if they could be restricted to only renting to other people from those areas, that it wouldn't be like your typical tourist coming in," AJ Hames said.
Outcome: No ordinance vote occurred. Planning staff said the current draft reflects the BOCC compromise that allows intra-community rentals in some north-of-Cape-Rock neighborhoods but otherwise maintains a prohibition on typical tourist VHRs in those areas. Staff offered to accept public comment at the meeting and suggested private follow-up for residents seeking specific application of the rule to addresses.
