The Kentucky Supreme Court ruled against the city of Prospect in the city’s appeal of a zoning change that allowed an LDG apartment project to proceed on Timber Ridge Drive, Mayor Doug Barnsley told the council Tuesday.
"The Kentucky Supreme Court made its decision on Prospect's appeal of the zoning change ... the Supreme Court ruled against Prospect and the zoning change will stand," Barnsley said. He described the outcome as disappointing but said the result was not surprising to the city’s lawyers.
Barnsley said a separate lawsuit filed by LDG against the city is ongoing; the trial had been scheduled for mid‑July but the judge postponed that date and a new trial date is expected to be selected soon.
The mayor delivered the summary during his report to the council and did not propose specific follow-up actions during the meeting.
