Council pauses $350,000 transfer for neighborhood council formation pending legal and equity review

Councilmember Janice Hahn asked the city to transfer $350,000 to the Department of Neighborhood Empowerment to support formation activities for neighborhood councils, including basic outreach costs such as copying, postage and meeting materials.
Hahn said many early neighborhood councils had relied on volunteers who paid out of pocket to form councils and asked whether the proposed funds could reimburse those expenses. The City Attorney said, based on initial consultation, the money could not properly be used to reimburse previously incurred expenses and raised concerns about whether giving money to groups prior to certification could be a prohibited gift of public funds and an equity issue for councils forming later.
Councilmember Cindy Miscikowski and others noted the money had been earmarked in the budget (unappropriated balance) for outreach and that district offices had been assisting with in-kind support. Members asked the Department of Neighborhood Empowerment and the City Attorney to clarify whether verified, documented formation expenses might be reimbursed, and whether a fair distribution process could be established.
Because the city attorney did not have a final determination available at the meeting, the council voted to continue the item to the next council session on Friday to allow the city attorney and departmental staff to provide specific legal and procedural guidance.
