Sutter LAFCO approves Tiara Estates annexation but removes neighboring parcel after traffic, flooding concerns

SUTTER COUNTY — The Sutter Local Agency Formation Commission voted 4–2 to approve the Tiara Estates annexation into Yuba City but removed a proposed expanded parcel after extensive public comment about traffic, drainage and safety.

LAFCO adopted a resolution approving a change of organization to annex 8.85 acres (Tiara Estates Annexation No. 342) — a 31‑lot single‑family subdivision at 2103 Elmer Avenue — to Yuba City, while excluding 2131 Elmer Avenue (approximately 1.19 acres) from the final approval. The motion was made by Chair Boomgarden and seconded by Commissioner Chaplin. Commissioners Baines, Chaplin, Munger and Chair Boomgarden voted yes; Commissioners Elthick and Ziegenmeier voted no.

The commission’s staff presentation, given by Executive Officer Douglas Libby, summarized the proposal and LAFCO’s review under Government Code Section 56668 and the agency’s annexation policies. Libby said Yuba City had processed a tentative map and adopted a mitigated negative declaration as the lead agency under CEQA, and that LAFCO would act as a responsible agency by considering the city’s environmental document.
