The Pompano Beach Zoning Board of Appeals on May 15 approved a special exception to allow a professional office at an older multi‑tenant property in the Avalon Harbor / Belcrest area that has operated as office since 1973.
Scott Reale advised the board that while the site historically housed offices, ordinance changes in 1993 removed office as a permitted use in multifamily districts; therefore reestablishing the office requires a special exception. Staff recommended approval with conditions including resolving active code compliance case 20‑049006854, bringing parking, landscaping and signage into compliance to the extent practicable, and obtaining a business tax receipt.
The property owner said the site was constructed for office and has been used as such for decades; the owner said a full retroactive upgrade to meet current standards could be problematic because the site plan is not compliant with modern standards and that the owner intends to pursue rezoning to B‑3. The owner requested flexibility on requiring full upgrades immediately. Staff and the board agreed to require reasonable retrofitting "to the maximum extent practicable" and completion of needed items prior to issuance of a business tax receipt.
The board voted to grant the special exception by roll call. Approval will resolve an existing code enforcement violation if the owner follows the required zoning use certificate and business tax receipt process and addresses specified site elements.
