Legal counsel Monette told the board before it recessed into closed session that the items were: Item 3.1, conference with legal counsel on existing litigation pursuant to Government Code section 54956.9(b)(1) regarding the “Aqueous Film Forming Foam products liability litigation, settlement agreement between public water agencies and 3M,” U.S. District Court, District of South Carolina; Item 3.2, initiation of litigation pursuant to Government Code section 54956.9(d)(4) (one potential case); and Item 3.3, anticipated litigation, significant exposure to litigation pursuant to Government Code section 54956.9(d)(2) (one potential case).
No members of the public spoke on closed-session items. The meeting instructions noted that members of the public could observe and provide comment via in-person attendance, a Zoom webinar, or phone. The board secretary confirmed there were no public comments prior to the closed session.
After the closed session, staff reported out that “the board met in closed session for items 3.1 through 3.3, and there's no reportable action.” The board adjourned following that announcement. If technical difficulties had prevented an oral report, the agenda said a written report would be posted on the authority’s website by the end of day Thursday.
Roll call at the start of the meeting showed Director Castaneda, Director Cox, Director Martinez, Director Martinez Perez, Director Morrison and Director Yamani present; Director Delgado was absent. The meeting opened as a special meeting and included the pledge of allegiance before the closed session.
