Staff told the council three appraisals had been completed over several years: an early appraisal around $37,100 (for an earlier, smaller estimate of square footage), a second appraisal by Dustin Singleton in December 2024 for $39,300, and a later appraisal by Dave Holtby that was cited at $46,600 for 8,806 square feet. Staff said a formal offer was sent to the owner on April 1, 2025, for $42,700 and included information about the property-rights ombudsman's office.
The planning and legal background is lengthy: the need for the 1200 East alignment appears in multiple city master plans and an interlocal agreement dating to 2004 that envisioned a regionally significant collector connecting multiple municipalities. Staff told the council the subject parcel had been discussed in prior acquisition efforts and the city had previously purchased other parcels on the alignment.
Councilmembers said they regard eminent domain as a last resort but that the city's obligations under prior plans and the lack of a voluntary sale required the step. "This is tough for everyone," Councilmember Kenny said during deliberations; he voted in favor along with other council members.
The resolution authorizes the city to move forward with the condemnation process if settlement cannot be reached; staff again said negotiations remained open. The council's vote was recorded as unanimous.
