Staff presentation and rationale: Planning staff presented the request under sections 303 and 317 of the planning code to remove an unpermitted demising wall that had split a legal second‑floor flat into a rear unit that lacked a living room and kitchen and a front portion. The department reported that building department investigations in 2021 identified two unauthorized units on the property (in addition to two legal units); the ground‑floor UDU is being legalized as an ADU and the Second‑Floor UDU is the subject of the current request. Staff concluded that restoring the flat maximizes family‑sized housing and is compatible with neighborhood policy, and recommended approval.
Owner remarks and justification: A co‑owner said the illegal separation existed before they purchased the building in 2021 and that the UDU lacks sufficient space for a legal kitchen or living area. The owner said the unauthorized unit has not been rented since 2020 and that legalizing it as a separate unit would be costly and likely reduce livability.
Commission action: The commission approved the conditional use authorization with conditions by unanimous vote (7–0). Commissioners emphasized the residential flats policy that favors family‑sized units and noted that legalizing the ground‑floor ADU separately addresses other housing on the property.
Ending Staff will record the approval and the property owner will proceed with the approved restoration and required permits to remove the demising wall and restore the Second Floor flat.
