What happened at the meeting Planning staff told the commission the site has been used as a wastewater plant since the 1970s and that the replat is required to bring the property into compliance for permitting purposes. Staff said the applicant failed to meet all notification requirements because the mailed notices stated a water plant rather than a wastewater plant.
A resident who identified herself as Aisha spoke during the public hearing and asked whether Chapter 42 distinguishes between water and wastewater plants and asked for clarity because the aerial imagery and site context suggest a wastewater facility. Commissioners agreed that the community should receive correct information and that a deferral was appropriate to allow time for corrected notices.
Action taken The commission approved staff’s recommendation to defer the item so the applicant can reissue proper notice that clearly states the intended use and to allow legal review. The motion carried.
Next steps Staff said the deferral will give the applicant time to correct notice language and for legal to confirm there are no other notice or procedural defects; the item will return to the commission after corrected notice is completed.
