The Town of Danvers Planning Board on May 13 voted to release the municipal interest in the performance guarantee for the Beaverbrook Woods definitive subdivision (Maple Street, lots 303 to 333), concluding the subdivision’s construction and municipal services were satisfactorily completed.
Jean Hartnett, the board clerk, read a certificate of completion that documented the plan recorded in the Southern Essex District Registry of Deeds and stated the performance security amount and statutory basis: “The performance of the subdivision is secured by $17,600 held under a tripartite agreement. Pursuant to MGL chapter 41 section 81‑U … the Danvers Planning Board hereby releases its interest in the performance security referred to above,” Hartnett read.
After the certificate was read, the board moved and seconded the release; Tim Spiddle seconded the motion. Chair Louis George called for a vote and the motion carried with four members voting in favor and one member, Jim Sears, recusing himself from the matter.
Why it matters: the action removes the town’s hold on the recorded performance security for Beaverbrook Woods, a step that typically follows satisfactory completion of road and utility work and final inspections.
What the board recorded: the certificate states the plan date and revisions and identifies the plan book and plan number at the Southern Essex registry. The release document cites Massachusetts General Laws, chapter 41, section 81‑U as the statutory authority for releasing municipal interest in subdivision performance securities.
The board asked planning staff if any further administrative steps were required; staff indicated none. The clerk’s certificate and the board motion are entered in the planning board minutes.
Ending: The board’s decision formally closes the town’s municipal interest in the Beaverbrook Woods subdivision performance guarantee; the applicant thanked staff and board members at the meeting.
