Marshall told the council he plans to sell prepackaged items (ice‑cream sandwiches, bars and popsicles), take cash and electronic payments and operate from designated waterfront locations such as Brown Beach and Ponderosa Park. He said he would step off the tricycle and push the cart onto the path when selling and is exploring a punch‑card option and a small freezer location at the ice rink for restocking.
As proposed, Marshall will remit 3% of daily gross sales to the city. The council approved a motion to grant the concession for one year with the option to renew, and directed staff to work with the city attorney to develop a formal concession-use agreement; the mayor was authorized to sign the final documents. The vote was unanimous.
Council members praised the entrepreneurial initiative and noted the concession offers a low-impact business opportunity in city parks. Staff said any minor changes raised by council could be incorporated into the formal agreement before signature.
The approved concession is conditioned on the terms that will be formalized in the concession-use agreement, which staff will bring back for signature and implementation details.
