Colorado Senate approves bill creating building decarbonization enterprise after cleanup amendment

The Colorado Senate on May 6-7, 2025 passed House Bill 12 69, creating a pre-building decarbonization enterprise and making an appropriation, after adopting a third-reading amendment to remove contingent effective-date language.

Senator Kipp moved final passage of HB 12 69 on third reading. Senator Simpson offered a third-reading amendment (L30) that sponsors and the drafter had worked on to remove conditional language that had tied parts of the bill to the fate of other bills (House Bill 12 67 and House Bill 12 68). "It does again, it cleans up the the re revised bill and takes out those conditions that have to happen that would have had to happen in either house bill 12 68 or house bill house bill 12 67," Simpson said when moving L30.

The chamber granted permission to offer the amendment, adopted L30 unanimously (35-0), and later passed the amended bill on third reading. The final vote on passage was 24 ayes and 11 noes; the clerk announced "House bill 12 69 is passed."

The amendment removed cross-references that would have made the enterprise's effective date contingent on other legislation. Sponsors said the change restores language closer to the re-revised bill while removing an unnecessary contingency that had been added during prior floor action.

House Bill 12 69 was introduced as a measure "concerning building decarbonization measures and in connection therewith creating a pre building decarbonization enterprise and making an appropriation." The bill is now passed by the Senate; the transcript notes cosponsors and moved on to subsequent business.

Votes at the clerk's announcement recorded 24 ayes and 11 noes on final passage. The record shows L30 was adopted 35-0 before the final vote.
