Committee Chairman Lynn opened the short executive session by describing a shared plan among members and said the attorney general—s office supplied late input asking for language that would not impair its ability to bring criminal prosecutions: "they don't want anything that's done in this bill to in any way impact their ability to bring a criminal prosecution," he said.
The motion to reconsider was moved by Representative Kuttab (“I move to reconsider our vote on SB 148.”) and seconded by Representative Smith. After the motion carried, Representative Manos moved amendment 20251922h and spoke to it: "My amendment is a, substitute all for the Birchland amendment. The only change it makes is it eliminates the paragraph on page 2, lines 17 through 19 of the Birchland amendment, and that's the only change it makes." The amendment passed by voice/show of hands; the committee then proceeded to the main motion.
Representative Birch urged support on the floor, describing the package as revised after significant work: "this is, the bill that has refused to die and has been on life support, and it's we're bringing it back to life," Birch said, and urged members to pass the amended measure. The committee then took a roll-call vote on the motion that SB 148 ought to pass as amended by 1922h; the clerk recorded 17 ayes, 0 nays.
Members said they will develop a separate floor amendment that incorporates language to address the attorney general—s concern and will circulate the proposed floor language to both caucuses and the attorney general—s office. Chairman Lynn said he expected to share draft language by early next week and that the item will be left on the regular calendar rather than consent.
The committee did not take other business and adjourned after the single-item session.
