Orange County approves rezoning for Share the Care adult day center after neighbors raise traffic and notification concerns

The board approved a Planned Development rezoning for Share the Care to develop a combined administrative office and adult day center on Wymore Road, south of Houston Avenue, in District 5. The motion passed unanimously after public comment from neighbors and a discussion about traffic, notice and stormwater.

What was requested: The applicant sought rezoning from PO (Professional Office) to PD to allow a 7,713-square-foot building with office and adult day health uses and four code waivers (reduced front/setback, reduced building-base landscaping and other standards) to make the proposed layout and vehicle access work on the site.

Neighbors’ concerns: Four residents spoke at the hearing. Madeline Fosmo said the neighborhood was not adequately notified of earlier notices and expressed concerns about increased traffic, drainage and impacts to the sidewalk and running routes. Frederick West, an adjacent property owner, and John Mitchell and Leon Huffman raised questions about the proximity of the building to existing structures, the size/capacity of the center and the predicted traffic impacts. Huffman asked repeated technical questions including, "what is the proposed and legal client capacity of the center? Is it 20 people, 50 people, a hundred people?" (public comment transcript). Staff and the applicant responded with project details.

Applicant response and conditions: Share the Care representatives said the center would be licensed based on usable client-service square footage and stated the developer anticipates a maximum of 25 clients per day at the proposed facility and hours of 7 a.m. to 6 p.m.; the director said clients generally attend for the full day. The applicant acknowledged concerns about right-turn movements onto Houston Road and agreed to consider operational controls; staff proposed a draft condition requiring that "upon submission of site plan, staff shall evaluate the feasibility of a restriction of right turns from the site onto Houston Road" (proposed condition 15). The board included that condition before voting.

Board action: Commissioner Simrad moved approval consistent with staff recommendations and the move passed unanimously after a brief discussion about notice and stormwater review. Staff noted the request establishes zoning; detailed engineering on stormwater and final drainage will be reviewed at the site plan stage.

Why it matters: Neighbors objected largely on traffic and notification grounds. Staff and the applicant said the proposed adult day center is a use allowed in office zones and that the PD route is being used to secure site-specific waivers so the nonprofit can build a facility designed to serve caregivers and older adults. The new condition directs staff to examine limiting right turns as a traffic-management mitigation when the site plan is submitted.

Ending: The board approved the PD with the staff-drafted condition to evaluate right-turn restrictions; final design details, stormwater engineering and any additional traffic mitigation will be addressed at DRC/site-plan review and through any conditions implemented at that stage.
