Metropolitan BZA Division 1 approves multiple variances, acknowledges continuances and withdrawals

The Metropolitan Board of Zoning Appeals, Division 1, chaired by Peter Nelson, cast votes to grant a set of expedited variances and handled several procedural requests including continuances and withdrawals at its public hearing.
The board read a list of expedited petitions into the record and approved each variance on the consent/expedited docket after a motion to waive the usual procedures. The expedited cases read into the record included variances for properties on Michigan Road, North Illinois Street (Meridian Hills), Rockville Road, West 604th Street, North Pershing Avenue, Meadows Drive, East Tenth Street, 5734 North New Jersey Street and others. Each expedited petition called and voted on in the record was approved; chair Peter Nelson and the four other members announced their votes on the record for each case as the clerk read results.
The board also approved meeting minutes from the April 1, 2025 session and confirmed procedural motions allowing the expedited docket to be resolved without additional testimony. Staff and petitioners asked for and received continuances without additional notice for several petitions (for example, petitions 2025DV1016 at 3406 Lafayette Road and 2025SE1001 at 2205 North Sherman Drive were continued to the June 3 docket at the petitioner’s request and with no objection from staff). Registered neighborhood organizations filed automatic continuances for other items (for example, 2025UV1006 at 5451 Mueller Road and 2025DV1017 at 1421 East Michigan Street), which the board acknowledged. The board also acknowledged petitioner withdrawals for items including 2025DV1014 (12 West 903rd Street) and 2025UV1007 (2222 Hillside Avenue) where petitioners indicated they planned to refile or withdraw.
Why it matters: The expedited approvals allow applicants to proceed without live testimony and reduce hearing time for cases staff and petitioners have agreed are noncontroversial. At the same meeting the board also set future hearing dates for continued matters that will return with additional staff review or corrected legal notice.
Board actions recorded in the hearing minutes include formal votes on the expedited docket, motions to continue specific petitions to the June 3 hearing (with or without additional notice as noted), and acknowledgments of withdrawals and automatic continuances. The board followed its rules of procedure and the Department of Business and Neighborhood Services’ protocols for notice and affidavit-of-compliance requirements for any conditions the board imposes.
Pending matters that were continued or withdrawn will appear on future dockets with staff reports and any required corrected legal notices.
