City clears contracts for Rachel at the Veil repairs after court denies temporary injunction; prior bidder files suit

The Fort Myers City Council voted May 5 to award multiple contracts totaling $90,891.93 to local contractors to repair the Rachel at the Veil site, and staff reported a prior bidder has filed suit seeking to protest the procurement.
City procurement staff described a phased approach using four local contractors for concrete, electrical, finishing stone and painting work. Keith Bennett, a city staff member, told council the combined price was substantially lower than a prior bid and that the work could be completed within a couple of months once plans are updated.
Assistant City Attorney Travis Carey said the prior bidder filed a lawsuit seeking an injunction to halt the city from moving forward with the contracts. "This afternoon... the court denied the motion for a preliminary temporary injunction," Carey said, adding the case remains active and further hearings are possible.
Councilmembers approved the contracts and asked staff about FEMA reimbursement guidance; staff said they had followed procurement diligence and that the project is expected to be covered but could be questioned during reimbursement review. A councilmember disclosed a potential conflict and recused themself from the vote because their property abuts the project site; the remainder of the council voted to proceed.
The city authorized four separate contracts: RAS Construction LLC ($23,600), AAA Specialty Products of Florida ($9,235), Elite Electrical Contractors Inc. ($47,056.93) and Falcon Painting Solutions ($11,000), for a combined amount of $90,891.93. The staff memo and council discussion indicate the city will serve as project manager and coordinate scheduling among the contractors.
City attorneys said the litigation seeks a protest and injunction rather than monetary damages; the denial of the emergency injunction allows the city to move forward subject to any future court orders. Council directed staff to proceed while noting the potential for additional court hearings on the protest.
