Kelsey Lanham, with Elbert County Planning Department, summarized the request: the applicant seeks to rezone the entire 40-acre parcel (Parcel F within Freedom Valley Ranch) from Agriculture to Residential Agriculture (RA). Lanham said the only substantive difference between RA and AR districts is a development standard (minimum lot width: 200 feet for RA vs. 250 feet for AR). She said the parcel is just southeast of Sun Country subdivision, north of East Sea West and approximately 5.6 miles east of the nearest RA-zoned parcels along County Road 174; the AR-zoned parcels are closer.
Lanham reviewed the referral history: the item had appeared previously and, following the last planning commission hearing, staff requested clarifications from referral agencies including the Division of Water Resources, Colorado Geological Survey and county engineering. Staff told the commission the three agencies had clarified their positions and did not object to the rezone; no outstanding objections remain in the packet. Staff recommended approval with conditions that include standard requirements to remove public-notice signs and to record the rezone exhibit within 180 days of BOCC approval.
Applicant representatives and nearby residents who spoke during the public comment period emphasized local water availability and the applicant discussed technical groundwater evaluation. Staff confirmed the project will continue through the county referral and BOCC public hearing process; the item is scheduled for a Board of County Commissioners hearing on May 14, according to staff.
A commissioner moved that the planning commission recommend approval to the BOCC, and the motion was seconded. The transcript records a voice vote in favor; the meeting packet and staff report will go forward to the Board of County Commissioners for final action.
