Council approves Hayden Sky Phase 1 preliminary plat; traffic mitigation agreement required before construction

Hayden City Council voted to approve the preliminary plat for Hayden Sky Phase 1 (PZEDash24Dash0130) but placed a clear precondition on construction: a traffic impact mitigation agreement must be negotiated and executed before construction-plan approval for the first phase.

The project was considered as a closed-record subdivision item. Staff and council discussed the Transportation Impact Analysis and identified required off-site intersection improvements at Hayden-Hutter, Hayden-Carrington and Downing-Hayden; condition 5 in staff recommendations requires a traffic mitigation agreement that allocates responsibility for those improvements prior to construction.

Councilor DePries and others sought explicit confirmation of who would carry the mitigation costs. City staff said the mitigation agreement is negotiated between the applicant and the city and would return to council for approval; the developer retains appeal rights if it disputes proportionate-share calculations. Councilors emphasized the record must show that property owners (and the developer) will not be charged beyond their proportionate share under the mitigation agreement.

Because extraordinary-impact determinations and related mitigation letters are separate documents not included in the closed record, staff explained those details will be negotiated and recorded in the mitigation agreement and brought back to council. The council approved the preliminary plat with staff-recommended conditions.

Roll call recorded one opposing vote: Council Member White voted no; other members voted yes.
