The Lakeville Conservation Commission issued partial certificates of compliance on May 13 for two newly constructed houses in the subdivision developed from the former driving range off Cross Street, approved a proposed backyard pool at one lot with standard erosion-control measures, and amended conditions for an active project at 9 Cross Street.
Partial certificates of compliance - 44 Cross Street: The commission voted to issue a partial certificate of compliance limited to the house and all associated grading and utilities (septic, grading and landscape associated with the house). The certificate explicitly excluded the roadway and drainage basins in the subdivision, which remain subject to further work and long‑term operation-and-maintenance (O&M) arrangements. - 2 Shamrock Lane: The commission issued a similar partial certificate of compliance limited to the house and associated grading and utilities; the developer remains responsible for finalizing ownership or an association to assure long-term basin maintenance.
Pool approval at 2 Shamrock Lane The commission closed the hearing on the proposed pool and patio and granted approval under a standard order of conditions. Conditions include standard erosion controls, a requirement to notify the conservation agent before dewatering or excavation begins, and confirmation that any backwash or filtration discharge meet the commission’s guidance (applicant told to notify the agent prior to starting work).
Amendment to 9 Cross Street order of conditions The commission amended the order of conditions for 9 Cross Street to include a limit on future fill: no more than 5,000 square feet of fill is permitted on the property. Commissioners explained the amendment was adopted after staff and counsel follow-up on a previously discussed deed restriction and will be reflected in the revised order of conditions and the certificate of compliance process. Commission members said long-term monitoring and timely completion of required wetland replication remain enforcement priorities.
Commission discussion emphasized that while the houses could be sold, the subdivision’s drainage basins and road acceptance or homeowners-association arrangements must be clarified before full certificates of compliance are issued. Members said developer Billy Logan had cleaned basins and that follow-up inspections and biannual reports would be required under the outstanding conditions.
