The Waukesha City Ordinance and Licensing Committee on May 12 held over the cigarette, tobacco and electronic vaping device retail license renewal application for Buma Smoke LLC after the business failed a recent compliance check and the applicant submitted an incomplete personal questionnaire.
Committee members said the clerk’s office and city attorney identified two problems: a single failure on a compliance check that occurred last year and an incomplete set of answers on the individual questionnaire submitted for one of the applicants. Omar, who appeared on behalf of the business, acknowledged the failed compliance check and said the company has added signage and daily automated reminders for staff to check IDs. Omar said his brother, the registered agent, was overseas and could not attend the meeting and that they would complete the missing questionnaire answers and return the application before the license renewal date of June 30.
City staff and legal counsel said the unanswered questions on the individual form render it incomplete and that the clerk’s office needs a finalized form before the committee can take formal action. The committee chair said the matter would be held over and the applicant should submit the completed materials to the clerk’s office; the item will return to the committee once the application is complete.
Committee members asked about additional steps Buma Smoke LLC is taking to prevent future compliance failures. Omar said the store is exploring ID‑scanning systems that would lock point‑of‑sale terminals until IDs are scanned; he said his current point‑of‑sale system does not yet support the scanner integration and that they were contacting vendors and their POS provider for options. The applicant estimated vendor response and installation could take “a few weeks to a month, maybe a little bit longer,” depending on vendor availability.
The committee did not vote to deny or approve the license; rather, it held the renewal over pending submission of the completed questionnaire and any documentation the clerks require.
