Monterey County planning panel approves lot line adjustment in Carmel to match existing fence

The Monterey County Planning Commission approved a coastal development permit on May 14 to allow a lot line adjustment between two legal lots at 26217 and 26219 Atherton Place in Carmel. The commission voted 7-0 to adopt staff recommendations finding the project categorically exempt under CEQA Guidelines Section 15305 and approving the adjustment.
The adjustment would align the legal property line with an existing fence that staff said was inadvertently constructed onto the neighboring parcel. ‘‘Rather than rebuilding the fence, the owners seek approval of a lot line adjustment to establish new property lines that align with the existing fence,’’ Planning staff member McKenna Bowling said during the presentation.
Staff told the commission the proposal does not include new development and that the resulting parcels meet minimum building-site sizes and site development standards. Staff noted the Carmel Highlands Land Use Advisory Committee voted 4-0 in support of the proposal at its April 7 meeting.
Joel Panzer, representing the Solomone Trust’s consultant team, told the commission the neighbors agreed the adjustment was the simplest way to correct the error. ‘‘Staff has recognized the very minor edits to the staff report that we’ve asked for clarity,’’ Panzer said, adding the applicant and staff were in agreement on the conditions of approval.
Commissioner discussion focused on confirming the zoning density and that neither lot would be reduced below its existing size. Commissioner Hill asked staff to confirm the density and whether either lot would be reduced; staff confirmed both lots remained no smaller than before.
Commissioner Diehl moved to approve staff’s recommendation incorporating the applicant’s minor corrections; Commissioner Shaw seconded. The motion carried, 7-0.
The commission’s approval authorizes only the lot line adjustment described in staff’s resolution and conditions; no building permits or new construction were approved as part of this action. The applicant’s requested edits were accepted and folded into the final conditions of approval.
