The Madison Plan Commission voted unanimously on May 12 to forward a zoning map amendment for 3821 Nakoma Road, recommending that the Common Council approve a rezoning from Plan Development (PD) to Limited Mixed-Use (LMX).
Brad Boden, the applicant and current owner, told the commission he initiated the rezoning to modernize a PD designation that dates to 1979 and includes outdated occupancy language. "It was partially to just get up to speed," Boden said, noting he has no current plans to expand or redevelop the property and that the LMX district better reflects small-scale mixed uses appropriate for the existing building.
Staff explained LMX is intended for small-scale mixed-use buildings in residential neighborhoods, typically more restrictive than other mixed-use districts and generally limiting developments to two stories and about 5,000 square feet absent a conditional use review. Staff said LMX would allow clearer, more modern standards to apply to the site than the legacy PD language.
A neighborhood registrant asked whether rezoning would allow new commercial uses or expanded parking; staff said LMX narrows but clarifies allowed uses (some neighborhood retail and office uses are permitted, while other uses may require conditional-use review) and that parking rules would be applied by use type.
Alder (mover) moved to forward the rezoning request with a recommendation to approve; the motion was seconded and carried unanimously.
The commission recorded the motion as a recommendation-only action: final zoning approval remains with the Common Council. The motion and staff comments on the record emphasize this rezoning is for map amendment only and does not itself change current uses or building footprint.
