Planning staff told commissioners the property contains about 16.92 acres in the Rural Urban Transition District and that the proposed two-story addition would include a two-car garage on the main level and an 882-square-foot secondary dwelling on the upper level. Staff advised the proposed addition would be “partially inside the overlay, which does not allow any new structures,” and that the overlay extends 100 feet from the Boise River floodway. Staff recommended approval, saying, “Staff finds that the application complies with the county code and recommends approval to the board.”
Staff reported the existing dwelling predates the overlay and that there was no alternative location on the parcel to construct an attached secondary dwelling without encroaching. The Idaho Transportation Department and Ada County Highway District registered no objections (a traffic impact fee will be assessed); Central District Health, the building official and the county engineer also had no objections. The hearing body moved, seconded and approved the project based on staff findings of fact and conclusions of law.
The hearing record identified the application as project number 202500390-AC-V (M Construction). The variance was approved by voice vote; the chairman announced “Aye” and the motion carried.
