Nogales Housing Authority board adopts procurement policy aligned with 2 CFR 200.317–200.327

The Nogales Housing Authority Board of Commissioners adopted Housing Resolution 2025-0504 at its May 7, 2025 meeting, updating the authority’s procurement policy to conform to the federal procurement standards in 2 CFR 200.317 through 200.327.

The resolution text presented to the board reads in part: "A resolution of the Board of Commissioners of the Housing Authorities of the City of Nogales revising the procurement policy to conform to the procurement standards identified in 2 CFR 200.317 through 200.327 to preceding resolution number 2009-06-02." The board called for a motion, took a voice vote and the chair announced, "Motion passes." No roll-call vote or individual vote tallies were recorded in the meeting transcript.

During discussion earlier in the meeting staff explained the authority would adopt HUD procurement policy language but populate it with the Nogales Housing Authority’s name to ensure HUD compliance. The director said: "It's the HUD procurement policy, and, actually, it's word for word except you populate it with the Nogales Housing Authority to make sure that we're in compliance with their regulations."

Several commissioners asked whether the authority should instead follow the City of Nogales procurement rules when those are stricter. The executive director advised that if the city’s procurement policy specifically names the Nogales Housing Authority then the city policy would be primary; otherwise the authority must follow HUD’s procurement standards.

The board took final action by voice vote. The resolution will supersede the prior procurement guidance adopted in 2009 (resolution 2009-06-02) as indicated in the resolution text presented to the board.
