Olathe City Council approves multiple IRBs, road and utility actions; several items pass unanimously

At its May 6 meeting the Olathe City Council approved a slate of industrial revenue bond (IRB) resolutions, infrastructure orders and routine consent items, voting unanimously on the items acted on that evening. A contentious sales-tax-exemption request for a mixed-use multifamily project was pulled for two weeks.
The Olathe City Council on May 6 approved a series of resolutions and ordinances covering industrial revenue bonds, right-of-way acquisitions and routine city business, with most items passing unanimously.
The council approved three separate IRB- and development-related measures after public hearings with no speakers. Resolution No. 25-1030 (Blue Spring Safety Storage South LLC) and related documents for a single-series IRB and tax phase-in for a proposed 62,000-square-foot industrial building passed 6-0 after the council closed a hearing with no public comment. The council also approved a master IRB resolution and a first amendment to an annexation agreement for Aspen Funds LLC (Resolution No. 25-1031), and a related resolution for the first building in that business park (Resolution No. 25-1032). Each passed on roll-call votes recorded as 6-0.
On the consent calendar the council approved a range of routine business items following motions to pull several items for separate consideration. Travel authorization for Municipal Judge Kinney to attend the All Rise conference in Kissimmee, Florida, was approved. A real estate contract to sell 114 East Santa Fe Street to Falco LLC was approved after separate consideration. The council approved an annual payment-processing authorization to Paymentus Group, Inc. and authorized engineering and land-acquisition actions for the Quivira Road improvement project (PN 3-C-011-24) by separate roll-call votes. A rezoning and preliminary development plan for a public-safety training facility (the Olathe Range) also passed on a separate vote.
One item pulled from consent drew extended discussion. Resolution No. 25-1034, an inducement application seeking a sales-tax-exemption-only IRB for the proposed Montage Apartments at 1051 North Merlin Road, led to debate over consistency for multifamily incentives and whether the city needs a formal policy. After discussion the council voted to table the item for two weeks to allow staff and council members to gather additional information. The motion to table passed 6-0.
Several items included staff presentations that identified projected public benefits. For example, the Blue Spring project was presented as a $21.5 million investment that would produce an estimated $42,000 in annual city property tax after a 10-year abatement period and an expected 50 indirect jobs over 10 years. The larger Aspen Funds business park was presented as a $140 million project with Phase 1 investment of about $28.6 million and an estimated $104,000 in annual city property tax following abatement.
Following roll-call votes the clerk recorded the outcomes; most measures passed unanimously. Where roll calls were read, the clerk recorded motions passing 6-0 unless otherwise noted. Items formally continued or tabled were recorded in the minutes as such and will return to a future meeting when scheduled.
The council closed the regularly scheduled meeting after new business and acknowledgements.
