The magistrate amended a prior compliance schedule for the unit occupied by Cooper Square / Cargo Coffee (Cooper Square 26) after the landlord said the tenant had vacated and the landlord was seeking a new tenant or remediation plan.
Mark Young told the court corrections to the permit application had been received on April 7 and that the lease for the unpermitted tenant had been terminated; the landlord’s representative Freddie Bolton said the landlord took possession and prospective tenants were considering the space. The city clarified that the building improvements in place were unpermitted and would either need to be permitted or removed.
The magistrate amended the earlier compliance date of Jan. 31 to June 3 and set a status hearing for June 4. Kleinman said that if a new tenant seeks to operate with those improvements, the landlord must either pursue permitting to remediate the unpermitted work or secure a demolition permit to remove the improvements. No fines were levied at the May 7 session, but the magistrate reiterated the administrative fee obligation for the proceeding.
