Magistrate: tiny house at 10701 SW 50th Fourth Street must be removed or permitted; fines resume June 1

Property owner Shana Shamsov asked the special magistrate on May 7 for more time to secure demolition or retrofit permits for a “tiny house” located at 10701 Southwest 50 Fourth Street and said the structure is not in use.

Mark Young, chief structural inspector for the City of Cooper City, told the court the city had not received any demolition or building permit applications for the unit and that the structure’s position on the lot did not meet local rear and side setbacks. Young said that zoning staff had advised the owner the structure could not be relocated to meet setback requirements, leaving demolition as the likely remedy.

Kleinman told Shamsov the prior order — which set a compliance deadline of June 1 — would remain in place. “The fines are gonna continue to run,” he said, citing the order’s terms; the magistrate said fines would stop once a demolition permit had been applied for and issued. Shamsov said she had solicited quotes and received one demolition bid that exceeded $10,000 and asked for 60 to 90 additional days to secure competitive bids and a contractor.

Kleinman said he would consider a later extension only if the building department could confirm a permit application had been submitted before the next hearing. He scheduled the case for a June 4 status review and advised Shamsov that after a permit is obtained she may petition for mitigation of fines that have accrued.

No change was made to the original order at the May 7 proceeding; the magistrate emphasized that either a demolition permit or an approved building permit was required to stop the fines and allow the case to close.
