Council amends zoning text, removes retail tobacco specialty use from State Street zone

Midvale City Council on May 6 approved an ordinance amending sections of the municipal code to revise uses in several zoning districts and fix drafting errors. Staff said the text amendment removes language that would have allowed retail tobacco specialty businesses in the State Street zone — language that had been included in error — and retains other previously discussed changes to Safe Street, Regional Commercial and Clean Industrial zones.
Planning staff noted the council had tabled the ordinance at an earlier meeting to remove the retail-tobacco provision; the version before the council corrected that and additional mapping or typographical errors. Council members reiterated concerns about proximity of tobacco retailers to schools; staff said state code already sets restrictions for uses near community locations. The motion to approve the ordinance passed unanimously.
