Commission recommends rezoning for 170th/Flum area to RP4; applicant to escrow funds for future street

The Planning Commission recommended approval of rezoning case REZ-2025-1, allowing the applicant Inner Investcorp Development LLC to proceed toward RP4 planned cluster housing in the area near the southwest corner of 170th Street and Flum Road.

Staff described a revised layout that reduced driveway conflict points, shifted an internal connection further south, and added stormwater stilling basins to slow runoff toward an adjacent western property owner. The applicant reduced the duplex count slightly (from 92 to 90 duplexes, 180 units) and provided three north–south connections; where a future 170th Street connection might be available the applicant agreed to escrow funds so the city could construct the street if rights‑of‑way become available.

Commission discussion acknowledged drainage and traffic concerns. Staff noted the Blue Valley area has planned CIP work (design expected to start 2026 with construction anticipated in 2029) that includes a roundabout at 170th and Flum. A neighborhood meeting on March 27 attracted one resident concerned about drainage; staff and the applicant described coordination on stormwater design and added stilling basins intended to reduce flow velocity downstream.

The commission voted 11–0 to recommend approval with stipulations A through Z; the item will be considered by City Council on June 2 at 7:30 p.m.

Ending: Staff and the applicant will finalize stipulation language, including the escrow mechanism for future 170th Street construction, prior to council review.
