Council approves financing resolutions and development agreement amendment for Trails subdivision and TIF district
Summary

The Council approved a package of resolutions and agreements on May 6 to finance and proceed with infrastructure for the Trails subdivision and to finalize developer responsibilities under the TIF district.
City bond counsel explained that the council was considering the first of four resolutions authorizing construction and financing for drainage improvements that will serve Trails in Phase 2; similar resolutions for paving, water and sanitary sewer followed. Those resolutions were brought after the city received petitions signed by a required percentage of affected property owners asking the city to construct the improvements and assess the benefited properties.
Council then approved a supplemental design agreement for Trails Phase 1 that staff said was needed to extend trunk infrastructure and provide a loop connection and a school frontage turnout; staff reported design adjustments were necessary after review and to coordinate with concurrent Seneca water main construction. A motion to approve the Trails Phase 1 supplemental passed.
Council also considered a resolution authorizing an amendment and a new development agreement related to the Trails TIF district. Staff described two documents: (1) an amendment to the existing development agreement that reallocates responsibilities as property parcels and developers change, and (2) a new development agreement with a different developer (Hornet Capital, LLC) to accept responsibilities for constructing portions of the phased project. Council approved the resolution authorizing the city manager to sign those agreements, subject to ministerial revisions.
During discussion staff clarified that special assessments for the subdivision will be apportioned among commercial and residential lots, that the school district’s surrounding parcels will be handled under agreed terms, and that the TIF district supports mass grading and retention works that were necessary to bring land out of the floodplain.
Votes on the drainage, paving, water and sewer resolutions and the TIF development authorization were taken by voice and carried (no roll-call tallies recorded in the minutes).
