Board approves 0-foot street-side setback for KC Pool after right-of-way reduction; 5-0 vote

The Maricopa County Board of Adjustment voted 5-0 to approve BA250016, allowing a street-side setback of 0 feet where 20 feet is normally required, to permit placement of a swimming pool up to the property line at a Queen Creek-area parcel.
Staff explained that Maricopa County had reduced the right-of-way along 190th Street from 40 feet to 25 feet earlier in the year; the applicant is requesting to site the pool at the new 25-foot property line so the pool can be visible from the rear of the home. The applicant, Chad Casey, told the board the one-acre parcel had been parceled off with future right-of-way that limited usable yard area and said the proposed pool location provides visibility to supervise young children from inside the home.
Vice Chair Person and other board members confirmed the updated site plan and measurements; the applicant had sought a 3-foot setback initially and requested the continuance to pursue the 0-foot option. No opposition was recorded.
Motion and vote: Member Carden moved to approve BA250016; Member Clapp seconded. The motion passed 5-0.
