After vehicle-damage claim, Madison County board directs review of road-damage policy

Madison County supervisors voted May 5 to direct the county administrator and county attorney to review the county’s policy on damage claims arising from road defects after a resident, Patrick White, presented a claim of $5,660 for damage to his vehicle.

White told the board his vehicle was damaged in March on a county road; he said the road condition caused the damage and sought relief. The county attorney reviewed Mississippi law on liability in the record, citing statutory provisions read aloud (11-46-1 to 11-46-23 and a separate section appearing as 19-13-51, updated January 1, 2023). The attorney advised the board that the law limits county liability when the governmental entity lacked notice of a dangerous condition and that the insurance carrier had denied the claim for those reasons.

After discussion, Supervisor Griffin moved — and a second was recorded — to have the county administrator and the county attorney (and relevant staff, including the road manager and sheriff) examine and return with a recommended county policy on handling vehicle-damage claims and related enforcement measures (for example, hauling tarp and truck inspections). The board approved the motion by voice vote.

During discussion, several supervisors and speakers voiced frustration with existing state law protections for counties and expressed support for pursuing local policy changes to improve road maintenance, stronger regulation of hauling/truck safety on rural roads, and clearer claims processes. The board instructed staff to draft a reasonable policy and return with recommendations.
