The Town of Danvers Conservation Commission continued Abiomed’s request for a determination of applicability for site and facade improvements at 24 through 42 Cherry Hill Drive to its meeting on June 12 so staff can clarify the commission’s enforcement options if it issues a negative determination.
High Point Engineering’s Mike Fabiano, representing Abiomed, described a limited site-improvement project at 2442 Cherry Hill Drive that includes impervious paver patios, a small staircase and pervious paver walkway to improve pedestrian access between buildings, and removal of an existing sidewalk in one area to be converted back to grass. Fabiano said most work will occur in previously disturbed areas; the submittal includes a waiver request for limited work within the 35-foot and 50-foot buffer zones. He also said the project team will submit a municipal stormwater permit application the next morning.
Commissioners raised concerns that a negative determination of applicability could limit the commission’s leverage to require remediation or to enforce work if the applicant does not follow the approved plan. Staff said conditions can be attached to negative determinations and described enforcement options in general terms; staff also said they would check the extent of the commission’s authority before the next meeting. A town meeting member asked about historical items on the site, including a stone wall; the engineer said the current application does not propose work in the area referenced.
After discussion, the commission voted to continue the matter to the June 12 meeting to allow staff to confirm legal and enforcement options and to receive any additional materials the applicant provides. Mike Hood, Abiomed facilities manager, said a two-week continuance would not impede the applicant’s schedule. The applicant agreed to provide further documentation and to coordinate reports with conservation staff as requested.
